Terms of Service

4.1 You Remain the Owner of Your Rights

You remain the holder of all intellectual property rights you hold in the Content you submit. Bridge Boards claims no ownership of your Content: this section does not organise an assignment of rights, but a licence to use, the scope of which is defined below.

4.2 Your Warranties

For each item of Content you submit, you warrant:

• that you are its author, or that you hold all rights and permissions necessary to submit it and to grant the licence described in this section;
• that the Content infringes no third-party right, in particular no intellectual property right, and no contractual undertaking binding on you;
• that the Content contains no personal data relating to a third party that you are not entitled to disclose;
• that the Content complies with applicable law and with the rules set out in section 5.

You are solely responsible for the Content you submit and you indemnify Bridge Boards against any third-party claim based on it.

4.3 Licence Granted upon Each Submission

The licence described in this section is granted item by item: for a given item of Content, it is granted at the precise moment you submit it to Bridge Boards — saving a deal in the editor, including through automatic saving, importing a file, or duplicating a deal. It covers only Content actually submitted and extends to no future work.

This licence is non-exclusive and granted free of charge. The version of these Terms in force on the day of submission is recorded together with the Content: it is that version which determines the scope of the licence granted over that Content.

4.4 Rights Granted

For each item of Content submitted, and solely for the purposes listed in section 4.5, you grant Bridge Boards the following rights:

• Right of reproduction — to record, store, copy and back up the Content, in whole or in part, on any medium and in any format, in particular for hosting, backup and generating your exports.
• Right of communication — to display, communicate and distribute the Content, including to the public, on any medium and any device, within the service and the purposes listed in section 4.5.
• Right of adaptation and modification — to translate the Content, transpose it into another card or bidding notation, correct, reformat, index, split, annotate, summarise or combine it with other material.
• Right of analysis — to carry out any analysis, measurement, extraction and automated mining of the Content, including for statistical purposes.
• Right of inclusion in databases — to incorporate the Content, in whole or in part, into databases and datasets built and operated by Bridge Boards.
• Right of making available — to make the Content available to third parties, solely under the conditions of sections 4.5 and 4.6.

4.5 Purpose of the Licence

The rights listed in section 4.4 are granted for the following purposes only, which may be commercial in nature:

• operating, running, maintaining, securing and improving the Bridge Boards service;
• making deals from the catalogue available within training, practice or play features, including paid or subscription-based ones, under the attribution conditions set out in section 4.8;
• making Content available within a marketplace enabling users to acquire or licence content, under the conditions of section 4.11;
• producing statistics and building datasets, whether aggregated or not;
• developing, training, evaluating, testing and improving algorithmic systems and artificial intelligence models;
• use in other products and services published by Bridge Boards in the fields of bridge, card and board games, learning and training, or the analysis of game data.

4.6 Sub-licensing, Partners and Service Providers

Bridge Boards may grant sub-licences over the Content, strictly within the limits of the rights listed in section 4.4 and the purposes listed in section 4.5, to its users, customers, partners and service providers — in particular to users receiving Content distributed through a training feature or a marketplace, and to the hosting, computing, processing or distribution providers required for those purposes. Bridge Boards remains responsible for its sub-licensees' compliance with these Terms.

4.7 Territory and Duration

The licence is granted worldwide. It is granted for the statutory term of protection of the rights in the Content, including any extensions, subject to the withdrawal right set out in section 4.10.

Withdrawing an item of Content or deleting your account does not affect uses lawfully undertaken before that date, nor copies already incorporated into datasets, into trained algorithmic models, or into content already distributed or sub-licensed to third parties, which may continue to be used.

4.8 Attribution

Where an item of Content is shown to a user, in particular within a training feature or the marketplace, Bridge Boards displays the name or username of its author, unless that author has asked otherwise.

You may at any time ask to no longer be publicly named as the author of your Content, by writing to the contact address given in the Legal Notice. Bridge Boards may also offer a dedicated setting in your account.

Attribution is not guaranteed, however, where the form of use does not lend itself to it: building datasets, training and evaluating algorithmic models, statistical aggregates. Your moral right of attribution, referred to in section 4.9, remains unaffected in any event.

4.9 Moral Rights

This licence does not affect your moral rights, which are inalienable under French law, in particular your right of attribution and your right to the integrity of your work. You acknowledge, however, that the adaptations and modifications referred to in section 4.4 — translation, change of notation, reformatting, indexing, aggregation — are technically necessary for the operation of the service and for the purposes described in section 4.5, and you accept that they be carried out on that basis.

4.10 Withdrawing Content and Deleting Your Account

You may delete an item of Content at any time, and request deletion of your account by writing to the contact address given in the Legal Notice. Such deletion ends, for the future, any new use of the Content concerned by Bridge Boards, except for the uses referred to in section 4.7. Withdrawing Content under this section is without prejudice to your rights under the General Data Protection Regulation, described in the Privacy Policy.

4.11 Marketplace

Bridge Boards may offer a marketplace enabling users to make their Content available to other users for a fee. Your participation as a seller, the terms of your remuneration and the commission charged by Bridge Boards will be governed by specific terms, communicated and accepted separately before you put any of your Content up for sale. The licence described in this section also allows Bridge Boards to make catalogue Content available within that marketplace, under the conditions of sections 4.4 to 4.6.
